TERMS & CONDITIONS

Acceptance of Quote        

Acceptance of this quotation, whether verbally, in writing, by email, or by payment of the deposit, constitutes acceptance of these Terms and Conditions.

Deposit        

Deposit equal to 50% of the total quoted amount is required prior to commencement of works. No materials will be ordered, and no works will be scheduled until the deposit has been received and cleared.

Final Payment    

The remaining balance is due immediately upon completion of works unless otherwise agreed in writing. Boundary Built reserves the right to charge interest on overdue accounts at a rate of 10% per annum.

Validity of Quote        

Quotes are valid for 30 days from the date of issue. Boundary Built reserves the right to revise pricing after this period due to fluctuations in material, labour, or supplier costs.

Variations        

Any changes requested by the client after acceptance of the quote may result in additional charges. All variations will be quoted and approved before additional work is undertaken where reasonably practicable.

Access to Site        

The client is responsible for ensuring reasonable and safe access to the work site. Additional charges may apply where access restrictions result in increased labour, equipment requirements, or delays.

Underground Services        

Unless specifically stated, the quoted price does not include the location, protection, repair, or relocation of underground services including water, gas, electricity, telecommunications, drainage, irrigation systems, or other hidden infrastructure. Any additional costs arising from undisclosed services will be charged as a variation.

Boundary Location

The client is responsible for confirming property boundaries prior to construction. Boundary Built accepts no responsibility for disputes, errors, or costs arising from incorrect boundary identification. Where required, a licensed surveyor should be engaged by the client.

Delays        

Boundary Built shall not be liable for delays caused by weather conditions, material shortages, supplier delays, site conditions, acts of God, or other circumstances beyond its reasonable control.

Existing Structures and Landscaping         Whilst all reasonable care will be taken, Boundary Built is not responsible for damage to existing landscaping, irrigation systems, garden beds, lawns, pavers, concrete, or structures where such damage is unavoidable in the normal course of construction.

Removal of Existing Fencing        

Where removal and disposal of existing fencing is included, Boundary Built will remove materials identified within the quotation only. Hidden obstructions, excessive concrete footings, asbestos-containing materials, or other unforeseen conditions may incur additional charges.

Ownership of Materials        

All materials supplied by Boundary Built remain the property of Boundary Built until full payment has been received.

Cancellation        

If the client cancels the project after acceptance, Boundary Built reserves the right to retain the deposit to cover administration costs, materials ordered, labour allocation, and any losses incurred.

Warranty      

Boundary Built warrants workmanship for a period of 12 months from completion. Timber is a natural product and may shrink, expand, twist, crack, warp, or develop surface imperfections due to weather and environmental conditions. Such natural characteristics are not considered defects.

Timber Products        

Variations in colour, grain, knots, checking, sap content, and movement are natural characteristics of timber and are not grounds for replacement or warranty claims.

Photographs        

Boundary Built may take photographs of completed works for marketing and portfolio purposes unless the client requests otherwise in writing.

Disputes        

Any dispute arising from the works shall first be addressed through good-faith negotiations between the parties before legal proceedings are commenced.

Acceptance

Payment of the deposit, written approval, email confirmation, or instruction to proceed constitutes acceptance of this quotation and these Terms and Conditions.

Progress Payments

For projects exceeding $10,000, Boundary Built reserves the right to issue progress invoices at various stages of completion. Progress payments must be paid within the timeframe specified on the invoice. Failure to make progress payments may result in work being suspended until payment is received.

Rock, Concrete and Unforeseen Ground Conditions

This quotation assumes normal ground conditions suitable for fence installation. Should rock, buried concrete, tree roots, underground structures, excessive excavation, or any other unforeseen site conditions be encountered, Boundary Built reserves the right to charge additional costs for the labour, equipment, and materials required to complete the works. Any such costs will be discussed with the client prior to proceeding where reasonably practicable.

Neighbour Contributions and Boundary Agreements

Where the works relate to a boundary fence, the client remains solely responsible for obtaining any contribution, reimbursement, approval, or agreement from adjoining property owners. Boundary Built’s agreement is solely with the client named on the quotation, and full payment remains the responsibility of the client regardless of any arrangements with neighbours.

Material Delivery, Site Readiness and Storage

The client is responsible for ensuring the site is ready for works to commence as scheduled. Where materials have been ordered, delivered, or allocated to a project and the site is not ready, access is unavailable, or works are postponed at the client’s request, Boundary Built reserves the righ to charge reasonable storage, handling, re-delivery, rescheduling, or administration costs incurred as a result.

Hidden Hazards and Hazardous Materials

This quotation assumes the work area is free from hazardous materials. If asbestos, contaminated soil, hazardous waste, or any other unsafe material is discovered during the course of works, Boundary Built reserves the right to immediately cease work until the hazard has been appropriately assessed and managed.

Any resulting delays, specialist contractors, disposal costs, or additional works required will be at the client’s expense.

Boundary Built reserves the right to amend, change or add to these terms and conditions at any point in time 

Acceptance of the quote indicates to boundary built that all parties with shared interest or shared costs have agreed to all items and charges on quote, have agreed to all terms and conditions of the quote & of boundary built.

All parties will be invoiced for initial deposit prior to job and invoiced at time of completion of works.

If for any reason a party involved decides to change their mind on the initial quotes job it will be the responsibility of the person named on the initial quote to sort out, we will not be involved. if that party or any party who were invoiced from the initial quote refuses payment on the deposit, the remaining balance or any additional charges, it will be the responsibility of the person named on the initial quote to pay any and all remaining balances
